TPAI Charts — Terms of Use and Trading Risk Acknowledgment

1. Agreement and eligibility

These Terms govern your access to TPAI Charts through TitoVlogs, including its charts, indicators, analytical tools, market data, educational materials and related features expressly included in your plan. They apply to paid subscriptions, trials, promotional access and complimentary access.

You must be at least 18 years old, have legal capacity to enter this agreement, and comply with laws applicable to your use of the service. You must affirmatively accept these Terms before accessing TPAI Charts.

2. Analytical tools, not personalized investment advice

TPAI Charts provides software for market analysis and educational purposes. Its indicators, signals, chart patterns, alerts, examples and commentary are not personalized financial, investment, legal or tax advice.

Access does not create an investment adviser–client, brokerage, fiduciary or portfolio-management relationship. A displayed entry, exit, target, stop-loss, trend or other indication is an analytical output, not an instruction to trade or an assurance that a trade is suitable for you. Obtain independent professional advice where appropriate.

3. Trading involves substantial risk

Trading can result in the loss of some or all of your trading capital. Leverage and margin can magnify losses and, depending on the instrument and account terms, losses may exceed your initial margin.

Cryptocurrencies, foreign exchange, metals, derivatives and contracts for difference may experience rapid price changes, gaps, illiquidity, liquidation and other risks. Trade only with funds you can afford to lose. TPAI Charts does not guarantee capital protection, profitable trades, a minimum return, a particular win rate or recovery of previous losses.

Past performance, testimonials, screenshots, demonstrations and historical or hypothetical results do not guarantee future results. Such results may omit costs, slippage, financing charges, execution constraints or other factors affecting actual trading.

4. Your trading decisions and responsibilities

You remain responsible for deciding whether, when and how to trade; checking the instrument, broker, price, timeframe and market conditions; selecting position size, leverage, entries, exits and risk controls; verifying orders and positions directly with your broker or exchange; and understanding applicable fees, taxes, trading restrictions and account terms.

Do not rely exclusively on TPAI Charts when making a financial decision. A chart, alert or stop-loss indication does not guarantee that an order will execute, or execute at the displayed price. Unless separately and expressly agreed, TPAI Charts does not execute orders, manage your account or monitor your positions for you.

5. Data, indicators and technical limitations

Market data and analytical outputs may be delayed, incomplete, unavailable or incorrect. Indicators may recalculate as prices change, candles develop, historical data is corrected or software is updated.

Different brokers and exchanges may produce different prices, candles, spreads, volumes, session boundaries and indicator results. TPAI Charts does not promise identical results across providers or parity with another charting platform.

Connections may depend on third-party infrastructure and, for some feeds, a connected computer, terminal or publisher. Network failures, outages, rate limits, maintenance, software defects and third-party changes may interrupt service.

A “connected” or “live” label is not a guarantee of uninterrupted delivery or error-free data. Independently verify critical information before trading. If data appears stale, inconsistent or unavailable, stop relying on it until verified.

6. No responsibility for trading outcomes

To the fullest extent permitted by applicable law, you accept the financial risks of trading decisions you make using or referring to the service.

To the fullest extent permitted by applicable law, the Operator and its owners, personnel and contractors are not liable for trading losses, loss of capital, liquidation, missed opportunities, lost profits or similar financial consequences arising from your use of, reliance on, inability to access, or interruption of TPAI Charts. This applies whether a decision relates to an indicator, signal, alert, chart, example, data feed or other service output.

7. Service warranties and limits of liability

To the fullest extent permitted by law, the service is provided on an “as available” basis without a promise that it will be uninterrupted, error-free, suitable for your particular trading strategy or capable of producing a financial result.

To the fullest extent permitted by applicable law, the Operator is not liable for indirect, incidental, consequential, special or punitive damages, including lost profits, business interruption or loss of anticipated savings.

Where liability cannot lawfully be excluded but may lawfully be limited, the Operator’s aggregate liability arising from the affected service will not exceed the amount you actually paid for the TPAI Charts subscription or access package giving rise to the claim. These limitations apply only to the extent legally enforceable.

8. Digital products, access periods and no-refund policy

TPAI Charts is a digital product and subscription service. All sales are final. Payments are non-refundable except where a refund is required by applicable law.

We do not provide discretionary refunds for change of mind, non-use, trading losses, dissatisfaction with trading results, or failure to meet the technical requirements disclosed before purchase.

Your purchase provides access for the period and features stated in your selected offer. It does not guarantee profits, successful trades or recovery of losses. Complimentary and promotional access follows the conditions of the applicable offer.

9. Account security and permitted use

Keep your credentials confidential and notify support promptly of suspected unauthorized access. Do not share, sell, transfer or rent your account or bypass access restrictions.

You receive a limited, non-exclusive, non-transferable right to use the service during your authorized access period. Without written permission, you may not resell the service, redistribute protected data or paid content, rebroadcast paid access, commercially republish its outputs, or copy protected software. You must not interfere with security, misuse another person’s account or unlawfully extract data. Restrictions do not override activities expressly permitted by applicable law.

10. Third-party services and referrals

Brokers, exchanges, payment providers, communication platforms and data providers operate independently. Their availability, execution, fees, solvency and conduct are outside the Operator’s control.

A third-party name, connection or referral link is not a guarantee of that provider’s performance or suitability. Where applicable, the Operator may receive referral compensation; relevant relationships should be disclosed with the referral.

11. Privacy and acceptance records

Personal information is handled under applicable privacy law. Contact support with privacy inquiries.

The Operator may retain proportionate records of your acceptance, such as your account identifier, accepted terms version and acceptance timestamp, for account administration, compliance and dispute resolution. Acceptance of these Terms is not consent to unrelated marketing.

12. Suspension, changes and discontinuation

Access may be suspended where reasonably necessary to address security threats, unlawful activity, account sharing, payment issues or a material breach of these Terms. Where practical and appropriate, the Operator will explain the issue and provide an opportunity to resolve it. Suspension must not be used to avoid mandatory obligations to customers.

Features and supported connections may change. Material changes will be communicated appropriately, and applicable remedies will remain available if a paid service cannot be supplied as promised.

Updated terms will not retroactively waive an accrued claim. Material revisions may require renewed acceptance.

13. Governing law and disputes

These Terms are governed by Philippine law, subject to mandatory protections applicable to the customer.

Please contact support first with sufficient information to investigate a concern. This does not prevent you from seeking urgent relief, contacting a regulator or exercising a statutory remedy. Disputes will be brought before the courts or authorities having lawful jurisdiction.

14. Entire agreement and severability

These Terms, the applicable offer details and disclosed policies form the agreement concerning your access to TPAI Charts. They do not override mandatory law or enforceable promises made about the purchased service.

If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law.
